Water Rights Primer
Everything below is background for making sense of the other docs. If you find yourself reading a line like "88 cfs below Pueblo, Fort Lyon's 1880s senior is on a call, WWSP account is draining" and wanting the meaning underneath the jargon β that's what this file is for.
1. cfs β the unit water is measured in
cfs = cubic feet per second. It's how fast water is moving past a point in a river or canal.
One cubic foot is about the volume of a basketball. "88 cfs" means 88 basketballs of water passing every second.
Intuition:
- 1 cfs β 450 gallons per minute. About what a big irrigation sprinkler puts out. Fills an Olympic pool in ~16 hours.
- 15 cfs (Arkansas at Las Animas today) β a small creek. Wadeable. One farm's worth.
- 88 cfs (Arkansas below Pueblo today) β a decent small river. You wouldn't wade it.
- 700 cfs β summer target for the Arkansas through Brown's Canyon. Normal-year rafting flows. 2026 isn't expected to hit it.
- 1,000+ cfs β healthy spring runoff on the Arkansas.
- 10,000 cfs β flood stage on most Colorado rivers.
Handy conversion: 1 cfs flowing for 24 hours β 2 acre-feet of water. An acre-foot is a football field covered a foot deep. Roughly a family of four's annual use.
So "Fort Lyon is pulling ~73 cfs off the top" = ~146 acre-feet per day into the canal = enough to flood ~110 football fields a foot deep, every day. That's why a full canal looks so impressive.
2. Prior appropriation β "first in time, first in right"
Colorado ranks water rights by date, not by need or fairness. The date your ancestor (or the ditch company's founders) first diverted water sets your priority forever.
The buffet line analogy. Imagine everyone with a water right is standing in a line, sorted by date:
- 1861 right at the front (oldest senior)
- 1880s right next
- 1920s right behind them
- 1970s right at the back
When the river has enough for everyone, nobody cares about the line. When the river is short, the back of the line gets nothing, and so does everyone behind the point the water runs out.
You are not cut proportionally. You are cut completely. Colorado's system is rank-order, not share-the-pain.
3. Why Fort Lyon is special
Fort Lyon Canal's senior right dates to the 1880s. In the lower Arkansas, that's very senior. Only a handful of older rights exist in the basin, and most are small upstream ones. When the river runs short, Fort Lyon keeps diverting while almost everything downstream of its headgate gets turned off.
This is the specific reason the canal near McClave is flowing full today even while the Arkansas at Las Animas β 15 miles downstream β is almost dry.
4. Calls β how the line is enforced
A "call" is the mechanism that enforces the priority order. When a senior right holder isn't getting their full decreed amount, they call the State Engineer's office (Colorado Division of Water Resources, Division 2 for the Arkansas basin).
The division water commissioner then:
- Drives up the river from the calling structure.
- Identifies every junior right between the caller and the water source.
- Shuts those juniors off β sometimes literally with a wrench on a headgate β until the senior is whole.
"27 active Division 2 calls right now" means 27 senior structures in the Arkansas basin are currently calling on juniors. Juniors are being actively curtailed at 27 different points. That's a lot for mid-April and signals the basin is already short.
When water gets tight, calls cascade: Fort Lyon takes its full amount at the headgate β the river below nearly dries up β the next senior downstream puts on a call β everyone junior between them gets shut. That's why 88 cfs at Pueblo becomes 15 cfs at Las Animas β the seniors in the middle reach are taking what's left.
5. Winter Water Storage Program β the savings account
Before the 1970s, NovβMar river flow mostly ran unused down the Arkansas, past dormant fields, through John Martin Reservoir, and down to Kansas. From a Colorado farmer's perspective, wasted.
WWSP changed that. Starting in 1976, the lower Arkansas ditch companies (including Fort Lyon) got the right to store their winter flow:
- In Pueblo Reservoir (main pool).
- In each ditch company's own off-channel reservoirs (Fort Lyon uses Horse Creek and Adobe Creek, north of McClave β visible from town).
Nov 15 β Mar 14, water that would have run by gets captured and held. Starting in spring, they release it back down the canals for first and second cuttings.
The savings-account analogy. Each ditch has a savings account at Pueblo (and at their own small reservoirs).
- Winter: account fills up.
- Spring/summer: account drains as water is released to fields.
- Good year: snowmelt refills the river throughout summer ("fresh income"), so the savings don't empty much.
- Drought year: no snowmelt income β you're spending down the savings with nothing refilling it.
6. Why a full canal in April doesn't mean the drought is over
Today, on the Fort Lyon, you are watching a withdrawal from the savings account. It's WWSP release, not snowmelt. The Arkansas snowpack is 9% of median β there is no snowmelt to speak of.
- What's in the canal today = winter water captured NovβMar.
- That account went in below average (last winter was weak too).
- The longer the canal runs full at this pace, the faster the savings drain.
- When it empties, there is nothing behind it β the snowpack that normally refills the river is basically missing this year.
7. The 2002 analogy
2002 is the closest modern drought analog and it looked exactly like this in April:
- Canals ran full through spring.
- First cutting came in fine.
- People said "see, we're okay."
Then by July:
- WWSP accounts were empty.
- Snowpack yielded essentially nothing.
- Second and third cuttings got cancelled across most lower-Ark ground.
- Hay prices ran 40β80% above the trailing 3-year average by late summer.
The seller's $225 ask isn't speculation β he's seen this movie before. A seller who lived through 2002 will remember getting too few dollars out of his stack because he sold too early.
8. Quick reference β what each signal tells you

Every one of those signals points the same direction. That's why the seller is at $225 and won't budge.
